EEC Environmental (EEC) was retained by a large utility company to provide their expert witness support for an insurance cost recovery case involving heavy metal discharge to the Hackensack River from a former manufacturing plant whose operations began in the early 1900s. EEC reviewed a tremendous volume of sampling data, blueprints, aerial photographs, insurance maps, company memos, and regulatory agency correspondence in order to develop a sound technical and legal argument for why the original general liability insurance carrier(s) should reimburse millions of dollars in remediation costs that were allocated to our client.
The work involved development of an expert report and a rebuttal report, a deposition, and preparation for trial testimony before our client reached a favorable settlement with the insurance carrier(s).
